W3Industry (MSME registered, West Bengal, India) operates a digital technology platform at w3industry.com. This Disclaimer outlines the boundaries of our services, the limitations of AI-generated outputs and blockchain records, and the responsibilities of users engaging with our platform.

1. Nature of the Platform

W3Industry provides a digital infrastructure platform encompassing AI-powered image generation, blockchain-based proof-of-creation records (NFTs), custom software development, and SaaS web solutions. The platform is a technology service — we do not provide legal, financial, investment, or professional advisory services of any kind.

2. AI-Generated Content

Images, text, and other content generated through our AI tools are produced by machine learning models operated by third-party providers (including Replicate and OpenAI). W3Industry makes no representations regarding:

• The accuracy, originality, or uniqueness of AI-generated outputs.
• The suitability of generated content for any specific commercial, legal, or creative purpose.
• Whether any AI output is free from third-party intellectual property claims.

Users are solely responsible for reviewing AI-generated content before use, publishing, or commercialization. W3Industry is not liable for any claim arising from the use of AI-generated outputs.

3. Blockchain Records — Not Legal Copyright Registration

The NFT minting and blockchain certification service offered by W3Industry creates a timestamped, immutable record on a public blockchain that documents a user's claim of creation at a point in time. This record:

• Does not constitute official copyright registration under the Copyright Act, 1957 (India) or equivalent legislation in any other jurisdiction.
• Does not confer, transfer, or guarantee any intellectual property rights, legal ownership, or exclusive rights over the recorded content.
• Does not provide legal protection against infringement — users seeking formal IP protection should consult a qualified legal professional.

The blockchain record serves as a technological proof-of-existence and documentation tool only.

4. No Financial or Investment Services

W3Industry does not operate as a cryptocurrency exchange, NFT marketplace, financial intermediary, or investment platform. NFTs minted on our platform are digital records — not securities, financial instruments, or investment products. W3Industry does not provide any financial, trading, or investment advice. Users must not interpret any content on this platform as financial guidance.

5. User Responsibility for Submitted Content

Users are solely and exclusively responsible for all content they upload, generate, submit, or record through the platform. By using our services, you represent and warrant that:

• You are the original creator of the content, or have obtained all necessary rights, licenses, and permissions to use it.
• The content does not infringe upon any third-party intellectual property, privacy, or moral rights.
• The content is not obscene, defamatory, fraudulent, or illegal under applicable Indian law.

W3Industry does not verify, review, or guarantee the originality, ownership, or legality of user-submitted content.

6. System Availability & Technical Limitations

While we strive for high availability, W3Industry does not guarantee uninterrupted, error-free, or real-time platform operation. Service delivery may be affected by:

• Blockchain network congestion or validator downtime.
• Third-party infrastructure outages (AWS, Razorpay, RPC providers, AI model APIs).
• Scheduled or emergency maintenance windows.
• Force majeure events beyond our reasonable control.

7. Third-Party Dependencies

The platform relies on third-party services including but not limited to Razorpay (payments), Google (OAuth, Cloud), Amazon Web Services (storage), Replicate and OpenAI (AI models), Alchemy (blockchain RPC), and Pinata (IPFS storage). W3Industry is not responsible for the availability, accuracy, security, privacy practices, or pricing changes of any third-party service.

8. Blockchain Data Permanence

On-chain records are designed to be immutable and are not controlled by W3Industry post-minting. However, associated metadata and digital files stored on IPFS or other external storage systems may become inaccessible if those services change their terms or cease operations. W3Industry does not guarantee permanent accessibility of off-chain file storage.

9. Fees & Non-Refundability

All service fees (including the INR 49 minting fee) cover computational processing, infrastructure usage, and on-chain gas costs. These fees are non-refundable once services are rendered, as described in our Cancellation & Refund Policy. Fees do not imply any guarantee of commercial value, resale value, or legal rights associated with the output.

10. Limitation of Liability

W3Industry, its founders, employees, and service providers shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from: use of or inability to use the platform; reliance on AI-generated content; disputes related to blockchain records or ownership claims; third-party service failures; or any loss of data. Our aggregate liability in any circumstance shall not exceed the amount paid by the user for the specific service in question.

11. Updates to This Disclaimer

We reserve the right to update this Disclaimer at any time without prior notice. Continued use of the platform after any revision constitutes acceptance of the updated terms. We recommend reviewing this page periodically.
