Using Our Services Responsibly

Welcome to W3Industry (MSME registered, West Bengal, India). By accessing our website at w3industry.com or using any of our digital products and services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our platform.

1. Definitions

• "W3Industry", "we", "us", "our" — the MSME-registered entity operating w3industry.com from West Bengal, India.
• "Platform" — the w3industry.com website and all associated digital products and services.
• "User", "you" — any individual or entity that accesses or uses the Platform.
• "W3AI Collective Studio" — our AI image generation and NFT minting service.
• "NFT" — a non-fungible token minted on a blockchain network as proof of digital creation.

2. Eligibility

You must be at least 18 years of age to create an account or make a purchase on the Platform. By registering, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Services Offered

W3Industry provides the following digital services:

• W3AI Collective Studio — AI image generation and blockchain-based NFT minting.
• AI automation systems and custom digital infrastructure development.
• SaaS web solutions and platform licensing.
• Digital asset sales and downloads.
• IT consulting and technical advisory services.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice where practicable.

4. Account Registration & Security

• You may register using your email and password, or via Google OAuth.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at info@w3industry.com if you suspect unauthorized access to your account.
• We are not liable for losses arising from unauthorized account access due to your failure to secure your credentials.

5. Payments

• All payments are processed in Indian Rupees (INR) via Razorpay Software Pvt. Ltd., supporting UPI, credit/debit cards (Visa, Mastercard, RuPay), and net banking.
• Prices displayed on the Platform are inclusive of all applicable taxes unless stated otherwise.
• GST invoices are available upon request for eligible business purchases.
• We do not store payment instrument details (card numbers, UPI IDs) on our servers.
• All transactions are final upon payment confirmation, subject to our Cancellation & Refund Policy.

6. NFT Minting & Blockchain Terms

• By initiating a mint on the W3AI Collective Studio, you confirm that you are the original creator of or have the rights to the content being recorded on-chain.
• Blockchain transactions are irreversible. Once a record is written to the blockchain, it cannot be deleted or modified.
• The blockchain record serves as a timestamped proof of creation and does not constitute official copyright registration under Indian or international law.
• You are responsible for providing a valid and compatible EVM wallet address. W3Industry is not liable for assets sent to an incorrect address.
• W3Industry retains no ownership or rights over user-generated or user-submitted content.

7. AI-Generated Content

• AI image generation uses third-party model providers (including Replicate and OpenAI). Output quality, style, and accuracy are subject to model capabilities and are not guaranteed.
• You own the AI-generated images created using our Platform, subject to the terms of the underlying model provider.
• You agree not to generate content that is obscene, defamatory, illegal, or infringes upon the rights of any third party.
• W3Industry reserves the right to suspend accounts that misuse the AI generation tools.

8. User Responsibilities

• Use the Platform only for lawful purposes in accordance with applicable Indian law.
• Do not attempt to reverse-engineer, decompile, or exploit any part of the Platform.
• Do not use automated tools (bots, scrapers) to access or collect data from the Platform without written consent.
• Do not upload or transmit viruses, malware, or any content intended to disrupt Platform operations.

9. Intellectual Property

All trademarks, logos, platform code, design elements, and proprietary content on w3industry.com are owned by or licensed to W3Industry. You may not reproduce, distribute, modify, or create derivative works from our proprietary content without prior written permission. User-generated content (images, uploads) remains the property of the respective user.

10. Third-Party Services

Our Platform integrates with third-party services including Razorpay, Google, AWS, Replicate, OpenAI, Pinata, and blockchain networks. Your use of these integrations is also subject to the respective third-party's terms of service. W3Industry is not responsible for the availability, accuracy, or conduct of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, W3Industry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of profits, blockchain network failures, or third-party service outages. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 30 days preceding the event.

12. Indemnification

You agree to indemnify and hold harmless W3Industry, its founders, employees, and service providers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We reserve the right to suspend or permanently terminate your access to the Platform at our discretion, without prior notice, for conduct that violates these Terms, is harmful to other users, or is otherwise unlawful. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including payment obligations, IP rights, and limitation of liability) shall do so.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and applicable rules. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in West Bengal, India.

15. Changes to These Terms

We may revise these Terms periodically. Material changes will be communicated via email or a notice on the Platform. Continued use of our services after the effective date of changes constitutes your acceptance of the revised Terms.
